⚖️ Terms & Conditions – Seamind Experience Bali

1. Nature of the Service

Seamind Experience organizes and operates nature-based experiences in Bali, specializing in responsible snorkel tours. 

By booking or participating in any of our activities, you agree to comply with these Terms and Conditions. If you do not agree with any part of these terms, you should refrain from using our services.


2. Reservations and Payments

  • Eligibility: By booking with Seamind Experience, you confirm that you are of legal age and have the capacity to enter into binding contracts.

  • Accurate information: All personal and booking information must be truthful and complete at the time of reservation.

  • Payment: Payment for our activities must be made in full at the time of booking, in accordance with the prices and payment methods indicated.

  • Failure to pay: Seamind Experience reserves the right to cancel any reservation for which full payment has not been received.


3. Cancellation and Refund Policy

a) Wildlife Sightings

At Seamind Experience, we strive to provide the best possible conditions for marine encounters, sightings of wild animals can never be guaranteed 100%.
Marine life behavior is influenced by environmental and natural factors beyond human control.

  • Exception: For the Dolphin Swim Experience in Bali, another dolphin tour will be provided if no dolphins are sighted during the tour.


b) Cancellations Within 96 Hours

To ensure the quality and efficiency of our operations, the following cancellation rules apply:

  • Cancellations made more than 96 hours before the activity: Eligible for a full refund.

  • Cancellations made less than 96 hours before the activity: Non-refundable, as resources, staff, and logistics will already have been allocated.

  • In exceptional circumstances (such as medical emergencies or flight cancellations), we will review each case individually and may offer a reschedule or partial refund at our discretion.


c) Weather Conditions

Client safety and the protection of marine life are our top priorities.

  • If weather conditions make the activity unsafe, Seamind Experience reserves the right to cancel or reschedule the tour.

  • If Seamind cancels due to weather, clients will receive a full refund of the amount paid.

  • If conditions are not ideal but do not compromise safety, and the activity proceeds as planned, no refund or reschedule will be offered.

  • Final weather decisions are made on-site and on the day of the activity by our professional team, who assess safety based on real-time conditions.


4. Liability and Assumption of Risk

  • Inherent risks: By participating in marine and snorkel activities, guests acknowledge that there are inherent risks including, but not limited to, injury, illness, or loss of property. Participants voluntarily accept these risks and agree that Seamind Experience and its staff shall not be held liable for injuries, damages, or losses incurred during the activity.

  • Health conditions: Guests confirm they are in adequate physical condition to participate safely. Any medical condition, allergy, or limitation must be disclosed before the activity.

  • Safety compliance: All participants must follow the safety instructions provided by guides or crew at all times.


5. Intellectual Property

  • All images, videos, text, and materials produced or distributed by Seamind Experience are protected under copyright and intellectual property law.

  • It is strictly prohibited to reproduce, distribute, or use such content for commercial purposes without prior written authorization.


6. Environmental and Ethical Commitment

  • Touching, or feeding dolphins is strictly prohibited during all activities.

  • Participants are encouraged to use reef-safe sunscreen and minimize single-use plastics during the experience.


7. Modifications to Terms

Seamind Experience reserves the right to update or modify these Terms and Conditions at any time. Any changes will take effect immediately upon publication on our website. Clients are encouraged to review this section periodically to stay informed of updates.


8. Applicable Law and Jurisdiction


Any disputes or claims shall be submitted to the competent courts of Bali, Indonesia, unless otherwise mutually agreed.

 

 

⚖️ Terms & Conditions – Seamind Experience Sri Lanka

1. Nature of the Service

Seamind Experience organizes and coordinates tailor-made land itineraries in Sri Lanka and other international destinations, focusing on sustainable, cultural, and luxury or groups travel experiences.

We do not operate as an airline or flight-ticket issuer, and we do not sell flights. Any flight-related arrangements, cancellations, or refunds are the sole responsibility of the client or the respective airline.


2. Bookings and Payments

  • A deposit (percentage depending on itinerary length and type) is required to confirm the booking.

  • The final balance must be paid no later than 15 days before the start of the trip.

  • If full payment is not received within the indicated period, Seamind Experience reserves the right to cancel the booking without refund of the deposit.

  • Payments can be made via bank transfer or other officially accepted methods, in euros (€) or US dollars (USD).


3. Documentation and Visa

  • Each traveler is responsible for having a valid passport with at least six (6) months of validity beyond the travel date.

  • The Sri Lanka visa can be obtained online at www.eta.gov.lk or upon arrival.

  • Seamind Experience is not responsible for delays, denials, or issues arising from incomplete or incorrect travel documentation.


4. Cancellation and Refund Policy

The following conditions apply only to land services confirmed with Seamind Experience:

Cancellation notice period Penalty applied
More than 15 days before travel 25% of total amount
Between 15 and 6 days before travel 50% of total amount
Less than 120 hours (5 days) before travel 100% of total amount (non-refundable)

Special cases:

  • Adverse weather conditions: If safety is compromised, the affected service will be rescheduled or refunded.

  • Itinerary modifications: Any change requested by the client after confirmation is subject to availability and may incur additional costs.

  • No-show: Failure to appear at the agreed meeting point or on the scheduled date will result in loss of the full amount paid.


5. Client Responsibilities

The client agrees to:

  • Follow the instructions of the assigned driver or guide.

  • Respect schedules, local customs, and safety regulations.

  • Inform Seamind Experience in advance of any medical conditions, allergies, or special requirements.

  • Hold comprehensive travel insurance covering cancellation, medical assistance, and baggage loss.


6. Seamind Experience Responsibilities

  • Seamind Experience acts as an intermediary between clients and local suppliers (hotels, guides, transport companies, etc.), carefully selected for their professionalism and quality.

  • In case of any incident, Seamind Experience will liaise directly with the providers to ensure a prompt resolution prioritizing the client’s safety and satisfaction.

  • Seamind Experience shall not be held liable for losses, damages, or delays caused by force majeure, natural disasters, strikes, weather, or government decisions.


7. Modifications and Substitutions

If operational or force majeure circumstances require modifications to the itinerary, accommodations, or activities, Seamind Experience will ensure alternatives of equal or higher category without affecting the total value of the trip.


8. Claims and Complaints

  • Any claim must be submitted in writing within seven (7) days of the trip’s completion.

  • Seamind Experience commits to responding promptly and resolving each case with transparency and care.


9. Privacy and Data Protection

  • Personal data provided by clients will be used solely for trip management and direct communication.

  • Seamind Experience complies with the EU General Data Protection Regulation (GDPR), ensuring confidentiality and data security.
